By accessing or using the FallowKeep online store (the "Site") to purchase Mice, Headphones, or Controllers, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Site or purchase any products. FallowKeep reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site after any changes constitutes acceptance of the new Terms.

2. User Agreement & Account Responsibilities

As FallowKeep does not operate a user center or require account registration, all transactions are processed on a guest basis. You are responsible for providing accurate, current, and complete information during the checkout process, including shipping details and payment information. Any errors or omissions in the information provided may result in delays or failure to fulfill your order. FallowKeep is not liable for losses arising from inaccurate information provided by you.

3. Product Information & Pricing

FallowKeep strives to display accurate descriptions, images, and pricing for all Mice, Headphones, and Controllers. However, we do not warrant that product descriptions, colors, or other content are error-free, complete, or current. Prices are subject to change without notice, and all orders are subject to availability. In the event of a pricing error, FallowKeep reserves the right to cancel or adjust the order, and you will be notified via email at [email protected].

4. Limitation of Liability

To the fullest extent permitted by applicable law, FallowKeep, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, including but not limited to loss of data, loss of profits, or personal injury. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount paid by you for the specific product giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.

5. Intellectual Property Rights

All content on the FallowKeep Site, including but not limited to text, graphics, logos, images, product designs, software, and data compilations, is the property of FallowKeep or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content without prior written consent from FallowKeep. Unauthorized use of any intellectual property may result in legal action.

6. Refund Policy

FallowKeep offers a 30-day refund policy from the date of delivery for all Mice, Headphones, and Controllers. To be eligible for a refund, the product must be unused, in its original packaging, and in the same condition as received. You must initiate the refund request by emailing [email protected] with your order number and reason for return. Upon approval, you will receive instructions for returning the item. Refunds will be processed within 10 business days after we receive and inspect the returned product. Shipping costs for returns are the responsibility of the customer unless the product is defective or incorrect. FallowKeep reserves the right to refuse refunds for items that show signs of use or damage not reported at delivery.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Delaware.
